Terms and Conditions
The terms and conditions below are general in nature and may vary slightly for state to state. These are meant to be general rules of thumb, but lease specific restrictions will be included in your actual license agreement. They may vary, be more restrictive, and include restrictions not covered below. Refer to your individual license agreement or contact the local hunting representative for restrictions specific to your lease.
1. HUNTING: Permittees, club members, and guests agree to abide by all applicable state and federal wildlife laws and seasons now or hereafter in force in exercising the rights granted herein. In addition, use of the land falls under the following exclusions:
2. LAND USE: Permittees agree that due care will be exercised to prevent forest fires on the Land and that no timber will be severed, used, or destroyed on the Land. Permittees agree further not to engage in any activities, which tend to degrade the forest or water environment and agree to confine all vehicles (including automobiles, trucks, off-roads vehicles, motorcycles, motorbikes and bicycles) to established roads. Permittees will use their best efforts to extinguish any fire or fires that may occur on the Land and will notify Weyerhaeuser of all such occurrences during the continuance of this Permit.
3. STRUCTURES: Restrictions on structures vary greatly by lease. Please refer to your hunting license agreement for restrictions appropriate for your hunting area, or contact the hunting representative for the area you are interested in leasing. Any structure erected, whether temporary or permanent, may be destroyed by Weyerhaeuser without prior notice and without liability for damages to the structures or their contents. Any structures, whether temporary or permanent, shall have no electrical hook-ups or wells on the Land.
4. ACCESS: Permittees may be required to install gates. If Permittees install gates, all gates must be constructed according to Weyerhaeuser standards and must, at a minimum, have reflective paint, tape or other type of reflective device attached firmly thereto. Locking devices shall be supplied by Weyerhaeuser and Permittees. Gates shall remain locked at all times. Permittees shall not construct any other device designed to prevent access to the Land. Refer to you specific license for additional gate specifications and restrictions.
5. POSTING: Permittees shall, at their expense, post the Land. Posting of the property must be in accordance with state posting requirements. Signs shall be removed from the Land by Permittee upon the termination or cancellation of this Permit. No other signs shall be used without Weyerhaeuser approval.
6. DUMPING: All dumping of refuse of any type or description on the Land shall be strictly prohibited. Permittee shall immediately notify Weyerhaeuser of the existence of any unauthorized or illegal dumpsites. All personal trash (food & drink containers, etc.) shall be removed by Permittees when they exit the Land. Disposal of animal carcasses or entrails on or in ditches, roads or ponds is prohibited.
7. FOOD PLOTS: Construction of food plots as a supplemental food source for wildlife is permitted by Weyerhaeuser under the following conditions: (a) Food plots may be constructed in natural forest openings, logging ramps, decks, skid trails or roadsides, (b) in most cases, the location of food plots must be approved by Weyerhaeuser. Permittee acknowledges that forest openings are often used to support timber operations and Weyerhaeuser reserves the right to use these areas notwithstanding the presence or absence of food plots. Weyerhaeuser assumes no liability for damage to food plots caused by Weyerhaeuser, its contractors, agents or assigns.
8. DEER STANDS: Permittees shall construct no new permanent deer stands, which cause damage to trees of any species. In some cases restrictions as to how close a hunting stand can be located to a property line may apply. Use of nails, spikes, lag bolts, cotton spindles or screw-in steps is expressly prohibited. In most cases construction of “tower stands” is permitted. Weyerhaeuser assumes no liability for damage to deer stands of any kind caused by Weyerhaeuser, its contractors, agents or assigns. 9. ATV/ORV: ATV/ORV restrictions vary. See you license agreement for specifics related to you lease. Damage to Weyerhaeuser property from the use of ATVs/ORVs will result in the elimination of ATVs/ORVs from the lease area, suspension or termination of lease. Permittees will be held liable for damages and charged for restoration of disturbed areas.
10. Protection of Water Quality: Members and guest of the club agree not to engage in any activities which may degrade the water quality. This includes using forested buffers along streams or waterways for ATV trails, filing in streams or waterways for crossings, and any cutting trees or bushes within forested buffers for any purpose.
11. PERMIT AREA: Permittees agree to use the described land on attached map solely for recreation.
12. DAMAGES: Permittees are liable for damage to roads, trees, fences, and other improvements in the event that damage occurs through Permittees use of the property in excess of normal expectation for casual, non-commercial use. Charges for tree and property damages will be assessed as described in your license agreement.
13. MANAGEMENT ACTIVITIES: Timber harvesting or other land management activities may occur on the Land at any time during the term of this Permit including during the legal hunting season. Acceptance of this Permit constitutes acknowledgment by Permittees of the existence of this possibility. No refund or proration will be granted as a result of timber harvesting or other land management activities. Permittees shall not hunt in areas with active logging or other industrial forestry activities, nor shall they impair, impede or interfere in any way with the conduct of such activities by Weyerhaeuser or any of its contractors, including, without limitation, interference with log truck ingress/egress to the leased premises. Failure to comply with this provision may result in immediate termination of this Permit.
14. ASSIGNMENT: This Permit is personal to Permittees and may not be assigned or transferred. The hunting rights and privileges herein granted to the Club are not for commercial purposes and the Club shall not at any time sublease or permit fee hunting to persons who are not members or guests of the Club.
15. RELEASE, INDEMNITY AND HOLD HARMLESS AGREEMENT: Permittees acknowledge that Weyerhaeuser’s granting of this Permit is expressly conditioned upon Permittee’s agreement with all terms and conditions herein as evidenced by Designated Representative signing this Permit.
16. LIABILITY: Permittees hereby agree that hunting involves some degree of risk to persons or property and thereby assume all liability for any and all injuries or damages to persons or property arising in any way from the exercise of rights granted under this Permit. It is understood and agreed that Weyerhaeuser assumes no responsibility or obligations for the safety of the persons covered by this Permit or their agents, employees or guests. Each member or guest of the Club who exercises any privileges granted herein does, by such action, agree to indemnify and save harmless, Weyerhaeuser from and against any and all claims of liability and liability of any kind and nature, including without limitations for bodily injury, death, property damage and loss of property, arising out of such member's or guest's said action, regardless of negligence, and such member or guest, at such member's or guest's sole expense, agrees to handle all such claims, to defend all lawsuits filed against Weyerhaeuser on account thereof, to pay all judgments rendered against Weyerhaeuser in such lawsuits and to reimburse Weyerhaeuser for all reasonable expense, including attorney's fees and court costs, incurred by Weyerhaeuser on account thereof.
17. CANCELLATION: Should Permittees, their agents, employees or guests fail in Weyerhaeuser’s opinion, to comply strictly with the terms of this Permit, Weyerhaeuser reserves the right to cancel this Permit immediately without any liability on its part whatsoever. Weyerhaeuser reserves the right to cancel this Permit at any time for its own reasons should it so elect, even though Permittees have complied with its terms. In such event, Weyerhaeuser will refund to Permittees the proportionate part of the consideration paid for the unexpired portion of the applicable hunting season, without further liability on Weyerhaeuser’s part. No refund will be granted after expiration of the applicable hunting season. It is understood and agreed that if Weyerhaeuser elects to cancel this Permit, a letter to the addressee will be sufficient notice to all Permittees. All Permittees will from the date of such notice cease to exercise the rights herein granted, or to go upon the Land other than to remove posted signs. In the event Weyerhaeuser cancels this Permit for failure to make timely payment of the Annual Permit Fee when due, Weyerhaeuser may, at its option, reinstate the Permit, provided permittee pays Weyerhaeuser an additional late fee, or immediately offer the lease to the public. Late fees vary by region. Permittee acknowledges that during the term of this agreement Weyerhaeuser may, without notice to Permittee, sell or convey to a third party all or part of the Permitted Premises. Permittee agrees that in the event of such sell or conveyance this agreement shall immediately terminate unless Weyerhaeuser, at its option, elects to assign the agreement to the new owner of the Permitted Premises. Should Weyerhaeuser elect not to assign this agreement and the agreement terminates pursuant to the provisions of this paragraph, Weyerhaeuser shall return to Permittee an appropriate pro-rata portion of the Permit Fee.
18. ACCEPTANCE: Acceptance of this Permit by Permittees constitutes acknowledgment that violations of any of the above or of the general terms and conditions of the Permit is grounds for termination of the Permit without reimbursement or proration of Permit fee to Permittee by Weyerhaeuser. As an indication of agreement and acceptance of the conditions, stipulations and limitations herein, the Designated Representative will sign on the reverse side. Unless or until this Permit is approved by Weyerhaeuser and the Annual Permit Fee paid, Weyerhaeuser is in no way obligated hereunder.
19. INSURANCE: Insurance is required for all hunting clubs. In some regions insurance is provided and in some regions permittees are expected to obtain and maintain during the term Comprehensive General Liability insurance, including Bodily Injury and Property Damage. Refer to your specific licenses agreement or contact the local hunting representative for details related to insurance requirements for your lease.
20. ARCHAEOLOGICAL SITES: The Permittee shall insure that no archaeological sites or objects of antiquity on the permitted property are disturbed, altered, damaged or vandalized by any means, including but not limited to digging, probing or deliberately plowing or cultivating such site(s) for the express purpose of exposing artifacts or archaeological sites or other objects of antiquity. Permittee will insure that no state or federal laws pertaining to cultural resources and/or human burials on the permitted property are violated. Willful violation or disregard of such laws by the Permittee will result in immediate termination of the Permit.
21. MEMBERSHIP LIST: Permittee shall furnish and at all times, maintain on file with Weyerhaeuser, a current copy of the Permittee’s bylaws, and a list of all member names, addresses, telephone numbers and email addresses.
22. RENEWALS: Weyerhaeuser is under no obligation to renew the permit and any renewals shall be solely at the option of Weyerhaeuser.
23. FERAL HOGS OR OTHER EXOTIC SPECIES: Permittees shall not release feral hogs, foxes, coyotes, or any other native, non-native domestic or exotic species on the Land.
24. USE OF HUNTING DOGS: Restrictions associated with hunting dogs vary by lease. Please refer to your license agreement of local hunting contact for dog use restrictions that apply to your lease.
25. BEHAVIOR AND CONFLICT RESOLUTIONS: Weyerhaeuser expects hunting clubs to resolve internal and external issues on their own. This must be done in a peaceful, legal manner and with respectful behavior. Any unresolved EXTERNAL issues will be brought to the attention of the land use manager as soon as possible.
